Sentencing for Felonies Under Arizona Criminal Laws

While the range of punishment for a felony conviction in Arizona varies based on the specific offense, the basic structure for sentencing involves six classes of felonies:

  • Class 1 Felony: 25 years to life imprisonment or the death penalty
  • Class 2 Felony: Presumptive sentence of 5 years with a maximum sentence of 12.5 years imprisonment
  • Class 3 Felony: Presumptive sentence of 3 years with a maximum sentence up to 8.75 years
  • Class 4 Felony: Presumptive sentence of 2.5 years with a maximum sentence up to 3.75 years
  • Class 5 Felony: Presumptive sentence of 1.5 years with a maximum sentence up to 2.5 years

When the alleged victim is under the age of 15, however, the offense constitutes a class 2 felony, which is punishable under the enhanced sentencing provisions of the “dangerous crimes against children” statute.
